In compliance with the duty to inform set out in article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we inform you that the Internet portal https://atesmaps.org. (hereinafter, the "Website") is owned by Associació Atesmaps, with registered office at C/ Reis Catòlics 3, 2on 1a - 08017 Barcelona and tax ID (CIF) no. G05481882. This legal notice governs the conditions of use of the aforementioned Internet portal.

Applicable law and jurisdiction

In general, the relationships between Associació Atesmaps and the users of its online services on the Website are subject to Spanish law and jurisdiction.

The applicable venue will be that of the defendant's domicile, unless it concerns a procedure brought individually in defence of consumer rights, in which case jurisdiction will be at the choice of the claimant consumer, who may choose between the court of their domicile or the court that corresponds under articles 50 and 51 of the Civil Procedure Act (Ley de Enjuiciamiento Civil).

Acceptance by the user

This Legal Notice governs access to and use of the Website that Associació Atesmaps makes available to Internet users. A user is any person who accesses, browses, uses or takes part in the services and activities of the Website.

The user is informed, and accepts, that accessing this Website does not in any way mean the start of a commercial relationship with Associació Atesmaps.

Access to the Website by users is free of charge. Some services may be subject to prior subscription. Such a subscription is valid for the current season (which runs from November until 30 June of the following year).

Content and use

The user's visit to the Website must be made responsibly and in accordance with current law, good faith, this Legal Notice, and with respect for the intellectual and industrial property rights owned by Associació Atesmaps or any other natural or legal persons.

Using any of the content of the Website for purposes that are or could be unlawful is strictly prohibited, as is any action that causes or may cause damage or alterations of any kind not consented to by Associació Atesmaps to the Website or its content.

The owner of the Website does not identify with the opinions expressed on it by its contributors. The owner of the Website also reserves the right to make, without prior notice, the changes it considers appropriate to its Website, and may change, remove or add both the content and services provided through it and the way they are presented or located on its servers.

Intellectual and industrial property

The intellectual property rights in the content of the Website, its graphic design and its code are owned by Associació Atesmaps and, therefore, their reproduction, distribution, public communication, transformation or any other activity carried out with the content of the Website is prohibited, even if the sources are cited, unless the prior, express and written consent of Associació Atesmaps has been obtained. All trade names, trademarks or other distinctive signs of any kind contained in the company's web pages belong to their owners and are protected by law. The ATES cartography and the cartographic bases owned by third parties are excluded from this intellectual property.

Associació Atesmaps does not grant any licence or authorisation of use of any kind over its intellectual and industrial property rights or over any other property or right related to the Website, and in no case shall access to and browsing of the Website by users be understood to imply a waiver, transfer, licence or assignment, in whole or in part, of those rights by Associació Atesmaps.

Any use of that content not previously authorised by Associació Atesmaps will be considered a serious breach of intellectual or industrial property rights and will give rise to the liabilities established by law. Associació Atesmaps reserves the right to take the corresponding judicial and extrajudicial actions against the user.

Liability and warranties

Associació Atesmaps declares that it has adopted the necessary measures which, within its means and the state of technology, allow its website to work correctly and keep it free of viruses and harmful components. However, Associació Atesmaps cannot be held responsible for the following situations, which are listed by way of example and not as a limitation:

  • The continuity and availability of the Content.
  • The absence of errors in that content, or the correction of any defect that may occur.
  • The absence of viruses and/or other harmful components.
  • Damage or harm caused by any person who breaches the security systems of Associació Atesmaps.
  • The use that users may make of the content included on the Website. Consequently, Associació Atesmaps does not guarantee that the use users may make of the content that may be included on the Website complies with this legal notice, or that the Website is used diligently.

Associació Atesmaps may temporarily suspend access to the Website, without prior notice, for maintenance, repair, updating or improvement work. However, whenever circumstances allow, Associació Atesmaps will notify the user, in sufficient advance, of the planned date of the suspension of the content.

Likewise, in accordance with articles 11 and 16 of Law 34/2002, of 11 July, on information society services and electronic commerce (LSSICE), Associació Atesmaps undertakes to remove or, where appropriate, block content that may affect or be contrary to current legislation, the rights of third parties or morality and public order.

Associació Atesmaps uses cookies in order to optimise and personalise your browsing of the Website. Cookies are physical information files stored on the user's own device; the information collected through cookies serves to make the user's navigation of the portal easier and to optimise the browsing experience.
